Terms of Service

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

We offer a free Basic plan and a paid Plus plan with enhanced features and higher usage limits. Current plan details and pricing are available on our website and in your account settings.

All payment transactions are processed by our third-party payment processor, Stripe, Inc. By subscribing to a paid plan, you agree to Stripe's Services Agreement at stripe.com/legal/ssa. We do not store your complete payment card information.

Subscription fees are billed in advance on a monthly or annual basis. You may cancel your subscription at any time through your account settings or by contacting contact@pandada.ai. Cancellations take effect at the end of the current billing period.

We generally do not provide refunds for partial billing periods. However, if our Service experiences extended downtime due to technical issues on our end, you may request a refund by contacting us. We may change our pricing with at least 30 days' advance notice via email.

Your use of the Service is subject to usage limits based on your subscription plan. These limits may include restrictions on AI chat queries, web searches, file uploads, storage space, and report generation. Current limits for each plan are displayed in your account settings and on our pricing page.

Usage limits reset based on your time zone setting. When you reach a limit, you may upgrade your subscription or wait for the reset.

You agree NOT to:

• Upload illegal, harmful, or infringing content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers
• Use the Service for any automated or bulk data scraping
• Reverse engineer, decompile, or attempt to extract source code
• Resell, sublicense, or redistribute the Service without authorization
• Use the Service to process personal data in violation of applicable laws
• Violate any applicable laws, regulations, or third-party rights

The Service and its content are owned by Pandada and protected by intellectual property laws. You are granted a limited, non-exclusive license to use the Service. You retain all rights to your uploaded data and files. By uploading content, you grant us a limited license to process and store it solely to provide the Service. You own the reports, charts, and outputs generated from your content.

The Service integrates with the following third-party services:

• Google Login: For user authentication and account creation
• Stripe: For payment processing and subscription management
• AI Service Providers: For powering our analysis and chat features

Your use of these integrations is subject to the respective third-party terms and privacy policies. We are not responsible for the actions, policies, or availability of third-party services.

If a third-party service becomes unavailable or changes its terms, we may need to modify or discontinue related features of our Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee uninterrupted, error-free, or secure operation. AI-generated content is provided for informational purposes only. AI may make mistakes. You are responsible for verifying important information.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PANDADA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL ARISING FROM YOUR USE OF THE SERVICE.

We may suspend or terminate your access to the Service at any time for:

• Violation of these Terms
• Non-payment of fees
• Fraudulent or illegal activity
• Extended inactivity
• Any other reason at our sole discretion

Upon termination, your right to use the Service ceases immediately. We may delete your User Content after a reasonable period, though we are not obligated to retain it.

These Terms shall be governed by the laws of Delaware, United States. Any disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA), except where prohibited by law. Either party may seek injunctive relief in court for intellectual property matters.

• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.
• Assignment: You may not assign these Terms without our consent. We may assign our rights freely.
• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pandada.
